Our professionals represented the American Civil Liberties Union of Minnesota as amicus curiae urging the appellate courts to apply the state anti-SLAPP (Stretegic Lawsuit Against Public Participation) statute to a dispute between a government body and a citizen. The Watershed District claimed the defendant had breached a settlement agreement in a prior property lawsuit, and the defendant asserted that the claimed breach was protected speech. The Court of Appeals agreed that the anti-SLAPP statute applies to all civil lawsuits seeking damages, including actions based on alleged breach of contract and settlement agreements.
