Kyle T. Fogt

Associate

Kyle Fogt is a member of the Faegre Baker Daniels labor and employment practice. He focuses his practice on representing employers in employment-related litigation. Kyle also advises employers on their employee handbooks and other policies.

Kyle's litigation experience has included the following:

  • Defending employers in cases involving claims of discrimination and retaliation under various federal and state statutes, including Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and the Minnesota Human Rights Act
  • Defending employers in cases involving breach of contract claims and tort claims, including defamation, fraud and tortious interference with contract
  • Defending employers in whistleblower cases
  • Defending employers in cases, including putative collective actions, brought under the Fair Labor Standards Act (FLSA)
  • Representing employers in non-compete cases in Minnesota, Illinois and Texas

Kyle has extensive experience litigating cases in arbitration. He has also successfully defended a number of employers in charges of discrimination before the Equal Employment Opportunity Commission and state and local human rights agencies.

In addition to his employment law practice, Kyle advises colleges and private K-12 schools on issues related to students and faculty. He represents colleges and private K-12 schools in litigation, when necessary.

Prior to joining Faegre Baker Daniels, Kyle served as a judicial extern for the Honorable John A. Jarvey of the United States District Court for the Southern District of Iowa. In this role, he worked on a wide variety of civil matters before the court. In addition, Kyle served as a managing editor for the Journal of Corporation Law and as a member of the law school's national moot court team.
