Settled Putative Class Action on Behalf of Koch Industries
Date: September 2007
Case Name: Garcia, et al. v. Koch Industries, Inc., Case no. 351 F.3d 636
Jurisdiction: U.S. Court of Appeals for the Fifth Circuit, U.S. District Court for the Southern District of Texas
Our professionals represented Koch Industries in a putative class action in which plaintiffs alleged that Koch was liable for more than $300 million due to mismeasurement of hand-gauged oil in Texas between 1975 and 1989. Shortly after we became lead counsel, we persuaded plaintiff's counsel that class certification was extremely unlikely. We settled the case on an individual basis for a fraction of one percent of the total claim.
