Our professionals represented Koch Industries, Inc. in this class action arising out of oil purchases in North Dakota over a 14-year period. Plaintiffs alleged that the defendant mismeasured oil that it purchased through hand-gauged measurements at oil wells in the state of North Dakota from 1975 through 1988. The court certified a class before our firm became involved in the case (the case began in 1996; we took over the case as lead counsel in 2002). The total claim was approximately $45 million. After our involvement, the case settled favorably on the eve of trial, with a total payout to the class and class counsel of approximately $5 million. Class counsel appealed the district court's award of attorneys' fees and other aspects of the final judgment to the Supreme Court of North Dakota. We successfully defended all points on appeal.
