Jon divides his practice among government contracting practice, climate change and environment, and business litigation.
He has a broad array of experience in litigation and legal counseling, including the following:
Government Procurement
Jon has consulted clients on a wide array of federal and state procurement laws and requirements, including the Federal Acquisition Regulations, the Buy American Act, the Trade Agreements Act, the Export Administration Regulations, the Small Business Act, and many others. He has also represented clients in bid protests and litigation against government entities, including multi-million-dollar contract disputes with government agencies.
Jon's recent experience includes representing CH2M Hill PRC on a federal contracts dispute involving the Hanford Site as well as obtaining a multi-million dollar recovery from the State of Minnesota in a high profile state contracts dispute.
Climate Change
Jon assists clients in navigating the complex and rapidly evolving legal regimes to regulate greenhouse gas emissions. He has advised companies on regional, federal, and international cap and trade systems, as well as the EPA's greenhouse gas reporting rule, and he has represented aggregators in carbon offset projects involving rangeland, cropland, and methane capture. He coordinates a team of attorneys working on climate issues from several different practices and offices, and he is a frequent writer and speaker on climate change laws and regulations.
Environmental Litigation
Jon is an active member of the firm's pro bono practice and has briefed and argued several cases involving the protection of wilderness areas in the National Wilderness Preservation System from Georgia to Alaska. He was also one of the lead lawyers on the appeal preserving the reintroduction of wolves to Yellowstone National Park, and was on the plaintiffs' litigation team for the appeal of the Exxon Valdez case to the U.S. Supreme Court. He is currently an Adjunct Professor on Administrative Law at the William Mitchell College of Law, and sits on the boards of both Wilderness Watch and The Will Steger Foundation.
Commercial and Intellectual Property Litigation
Jon has represented clients in a wide variety of commercial and intellectual property litigation matters. He has litigated complex cases involving contracts, torts, patents, patent licenses, trademarks, trade dress, and trade secrets, for clients including ACS, Cargill, Guidant, and Pioneer. He has significant experience in both the health and medical device industries, as well as food and agriculture. He also has significant experience in e-discovery matters and acted as lead national discovery counsel for Google in a major trademark dispute.
