In an effort to get products and services to the market in the most efficient and effective way in this difficult economy, businesses often overlook two fundamentally important worker classification issues: whether to classify workers as employees or contractors and whether to classify them as exempt or non-exempt. These decisions, if made incorrectly, can result in disruptive government investigations and significant, sometimes destructive, litigation costs. Naming a worker a "consultant" or "independent contractor" does not cause the worker to be a consultant or independent contractor. Paying an employee a salary does not cause the employee to be "exempt" from the Fair Labor Standards Act. Investing a little time in proper worker classifications can save employers from enormous time and dollar outlays down the road.
