Ellen B. Silverman

Special Counsel

Ellen Silverman is a commercial litigator for the banking and financial services industry team.  Her clients include many of the largest financial institutions in the country, including Bank of America, Capital One, Discover, U.S. Bank, Wachovia and Wells Fargo.

Ellen represents her clients across a broad swath of the United States and has litigated cases in Minnesota, New Jersey, Rhode Island, Montana, Nevada, Missouri, Kansas, Nebraska, Colorado, Iowa, Michigan, Indiana, and Idaho.

She has successfully defended clients against every type of consumer claim, including claims under the Fair Credit Reporting Act, the Truth in Lending Act, the Fair Debt Collection Practices Act, and the Telephone Consumer Protection Act, as well as state consumer protection laws and foreclosure statutes.

Before joining Faegre Baker Daniels, Ellen practiced at Dewey & LeBoeuf and also worked in-house at MetLife. Her experience includes serving as lead counsel in the successful defense of a multi-million-dollar contract dispute, and she has represented numerous clients in arbitration before the American Arbitration Association.

Representative Cases:

Federal District Courts:

  • Scott v. Wells Fargo Bank, N.A., Civ. No. 10-3368 (MJD/SER), U.S. Dist. LEXIS 97301, at *21 (D. Minn. Aug. 27, 2011).  Obtained complete summary judgment on fraud claims in connection with alleged wrongful foreclosure.
  • Tacheny v. M & I Marshall & Ilsley Bank, 2011 WL 1657877 (D. Minn. April 29, 2011).  Obtained partial dismissal of TILA claims.
  • State of New Jersey DEPE v. Gloucester Env Mgt Serv., 821 F. Supp. 999 (D.N.J. 1993). Obtained partial summary judgment in ground breaking CERCLA decision.

State Courts:

  • Capital One Bank v. Hall, 247 P.3d 234 (Kan. App. Feb. 25, 2011). Successfully defended grant of summary judgment in consumer fraud action.
