Scott is the head of Faegre Baker Daniels' real estate practice group, and has practiced in commercial real estate since joining the firm in 1989. Scott has been involved in all aspects of commercial real estate, including purchases and sales, development, leasing, financing and workouts. Scott is Faegre Baker Daniels' principal real estate contact with Life Time Fitness, HNI, CarVal Investors, Gander Mountain Company, Holiday Companies, and United Parcel Service.
Purchase, Sales and Development. Scott has represented numerous clients in commercial property acquisition, disposition and development transactions across the United States. Representative transactions in these areas include:
- Target Corporation's development of numerous Target and Mervyn's stores throughout the United States, including purchase and land assembly, and shopping center development and redevelopment
- Holiday Company's acquisition and development of Holiday Stationstores and distribution facilities across the Midwest
- United Parcel Service's acquisition and development of distribution facilities in the Midwest and Rocky Mountain regions
- Metropolitan Airports Commission's acquisition and disposition of numerous commercial properties
- Acquisition and development of office, distribution and manufacturing facilities for numerous other corporations
- Acquisition and redevelopment of commercial shopping centers
Leasing. Scott has extensive experience in the leasing of retail, office, build-to-suit and industrial properties from both the landlord and tenant perspective, including:
- Target Corporation's ground leasing of several Target Stores across the United States
- Piper Jaffray & Co.'s office leasing transactions throughout the United States, including its anchor tenant lease and sublease of its headquarters facility in downtown Minneapolis
- Gander Mountain Company's leasing of it headquarters office in downtown St. Paul and leasing and development of numerous retail locations across the country
- Hines' leasing of office projects in downtown Minneapolis
- ReliaStar Financial Corp.'s leasing of numerous corporate properties
Financing and Workouts. Scott has extensive experience in commercial financing transactions, including representing both lenders and borrowers in all major types of commercial real estate financings, including capital lease and mortgage financing transactions. Scott also has significant experience in sale/leaseback, synthetic lease and other alternative real estate financing options. Representative transactions in this area include Life Time Fitness Inc.'s financing of its health club facilities through capital lease and mortgage transactions with Teachers Insurance and Annuity Association and sale-leaseback transactions with WP Carey, and ReliaStar Financial Corp. mortgage financing of commercial properties throughout the United States.
Additional Experience. Scott has also practiced extensively in 1031 tax deferred exchange transactions, including acting as lead counsel to Target Corporation in its 1031 exchange program in connection with its sale of its Marshall Field's and Mervyn's divisions. Scott has also counseled several clients in the acquisition, sale and management of hotels, the acquisition and financing of district heating and cooling facilities, and negotiation of steam and chilled water service contracts.
