Elizabeth Flaagan focuses her practice in the areas of bankruptcy, financial restructuring and creditors' rights. She is certified as a business bankruptcy specialist by the American Bankruptcy Institute's board of certification.
Elizabeth has represented creditors in such cases as Chrysler, Charter Communications, Hawaiian Telcom, Village Homes, Shane Co., Tronox, Pilgrim's Pride, Delphi, Adelphia, WorldCom, Genuity, Enron, Farmland Foods and Vlasic. Elizabeth also represents trustees, creditors' committees, lenders and asset purchasers in bankruptcy cases involving complex commercial issues, including matters that involve cross-border and other multijurisdictional proceedings. Representative engagements include:
- Representation of regional telecommunications providers in more than 40 telecommunications bankruptcy cases across the nation, as a trade creditor, committee member, secured creditor, preference defendant and potential asset acquirer
- Represented the largest senior secured lender in the Chapter 11 bankruptcy case of a large dairy operation, including representation in a subsequent receivership case and UCC foreclosure of all associated personal property
- Representation of one of the largest unsecured trade creditors and a member of the unsecured creditors' committee and subsequent liquidating trust committee in a Chapter 11 case and the subsequent liquidation trust of the largest steel manufacturer west of the Mississippi
- Representation of the senior secured lender in receivership actions involving distressed apartment complexes in Colorado
- Representation of the loan servicer in the workout and receivership of a $22 million loan facility secured by apartment complexes in Texas
- Representation of the agent/nominee in the workout of a $70 million senior secured loan facility secured by water rights
- Representation of the senior secured lender and syndicated loan participant of $72 million debt facilities in the Chapter 11 bankruptcy case of a large home developer/builder
- Represented the DIP lender, senior secured lender and potential asset acquirer in a Chapter 11 case of water park manufacturing entities
Elizabeth has also presented numerous seminars on various bankruptcy topics for the American Bankruptcy Institute, the Colorado Bar Association and CLE International and has guest lectured on bankruptcy topics at the University of Denver School of Law.
