Captive Insurance & Risk Retention Groups

As a captive insurance company or risk retention group, you provide a vehicle for organizations to reduce insurance costs, increase profitability, and obtain more control and flexibility over risk management. We help various groups form and manage captive organizations by serving as counsel. We assist captive insurance groups that serve financial institutions, construction companies, universities, hospitals, nursing homes, logistics companies and other organizations throughout the United States.

Formation

As you consider forming a captive, we perform the initial cost-benefit analysis to determine whether a captive is appropriate. If you choose to create a captive, we design and develop the specific program, evaluate the appropriate form of captive (pure, association, protected cell, etc.) and help you select the best domicile. We facilitate the process by preparing corporate and transactional documentation for formation, filing regulatory materials and helping you navigate the regulatory process. We help you develop a strategic captive business plan that includes product and reinsurance programs.

Management

Once your captive or risk retention group is operational, we monitor the operating plan and track results to ensure regulatory compliance and strategy implementation. We also analyze statutory and GAAP financial information and your captive's financial results. In select jurisdictions, we serve as a captive manager through FaegreBD Consulting, our federal affairs and business consulting division in Washington, D.C. Throughout the life of your captive, we advise you on corporate governance, securities law, tax requirements, and rating agency issues and implications.
