Faegre Baker Daniels handles the full spectrum of complex construction disputes that confront the real estate industry—everything from claims involving bid protests, delays, disruptions, constructive changes and insurance to charges related to defective construction materials and equipment. We have won major court and arbitration victories in most jurisdictions across the country.
Our lawyers also advise clients on the most effective contract documents to help avoid disputes and deliver projects on time and on budget. We provide counsel on documents for design/build, LEED certified and building information modeling projects, as well as integrated project delivery.
We represent all parties in the construction industry—including buyers, sellers, investors, agents, brokers, sureties, developers, governments, lenders, landlords, tenants, material suppliers, contractors, subcontractors and title insurance companies and their insureds—in a variety of real property litigation matters. Our experience includes mortgage and tax foreclosures, eminent domain, mechanic's liens and title insurance claims. We understand that resolving disputes in a practical and timely manner is important in the real estate industry where transactions typically occur within a short time frame. For that reason, our professionals strive to provide our clients with quick and decisive resolutions.
Construction Insurance
We represent contractors and owners in the full range of disputes arising from insurance contracts. Our lawyers are often called on to force property and casualty insurers to honor their coverage obligations, including work site injuries, wrongful death suits and losses allegedly caused by defective work or negligent subcontractors. We negotiate, arbitrate and litigate against insurers to secure coverage for policyholders, large and small. We also have represented owners and contractors to draw on performance bonds and recover when others failed to provide the insurance coverage their construction contracts required.
Our Voices in Construction
Since 1982, our lawyers have co-authored The Construction Review, an annual summary of the significant construction cases from across the country published by Thomson/West. Pat O'Connor, a partner in the practice, is co-author of the authoritative treatise on construction law, Bruner & O'Connor on Construction Law. Mark Voigtmann, another practice partner, writes a column, "Legalities: Engineering and the Law," in Control Engineering.
