Faegre Baker Daniels has handled environmental matters in federal and state courts in every region of the United States. We have tried cases involving all of the major federal environmental statutes—including Superfund, RCRA, the Clean Air Act, the Clean Water Act, TSCA, FIFRA, and NEPA—and have advised clients in high-profile administrative proceedings. We have handled lawsuits brought under a myriad of state environmental statutes and regulations.

We also represent clients in private arbitrations in which environmental issues are raised, including cases involving alleged breaches of environmental representations and warranties. We have tried numerous common law toxic tort, wrongful death, and personal injury cases, and we have helped our clients address insurance issues associated with environmental liabilities.

We know the complex statutes and regulations that are at the heart of these cases as well as the science associated with regulated substances such as PCBs, heavy metals, ethylene oxide, mold, asbestos, benzene, mercury, arsenic, and various pesticides. We understand the technical aspects of environmental law, including engineering, chemistry, hydrology, biology, and toxicology, and we have broad experience translating scientific and technical concepts to lay jurors, judges, and arbitrators. Many of our attorneys have formal training in the sciences or engineering, and we consult regularly with independent technical experts.
