Partner

Dave Foster provides legal and business counsel to financial institutions, entrepreneurs, corporations and other business entities. Dave represents commercial lenders and financial institutions in connection with loan origination and documentation (including secured, unsecured and mezzanine lending, and real estate mortgage and construction lending), bankruptcy, restructurings and workouts, creditors' rights and UCC issues, and foreclosure and receivership actions. He also represents public and private companies as well as individuals with regard to financial transactions, contracts, acquisitions and other business issues requiring legal input. In addition, he has represented individuals, business entities and airlines in aircraft financing, leasing, acquisition and maintenance transactions.

  • Counsel for Riverside Mfg. (designer and producer of wire harnesses, LED lighting, panel assembly, cables, switches and electro-mechanical products for harsh environments and military applications)
  • Counsel to Wells Fargo in senior lending facility originations
  • Member of Board of Advisors to  McNamara Florists
  • Counsel to publicly traded operator of specialty retail shoe stores  on corporate finance issues
  • Counsel to First Merchants Bank, secured lender, with respect to initiating general receivership action and the resulting sale of Delaware Machinery & Tool (a leader in the design, engineering, manufacturing, testing and sampling of highly complex tools utilized to manufacture die cast components for automotive, defense, medical and other industrial markets)
  • Counsel to privately held convenience store and fuel supply business with regards to senior secured and mortgage loan facilities
