David L. Kuosman

Partner

David Kuosman is a partner at Faegre Baker Daniels in the real estate group . His primary area of practice is commercial real estate, including development, leasing, lending, land use and governmental entitlements, brokerage issues, foreclosures, and purchase and sales transactions.

David has a broad and diverse client base which includes local entrepreneurs and national institutional real estate owners.  He is a valued member of his client's service team in working as a traditional counselor to provide strategic guidance and practical problem solving counsel.

Specific experience includes:

  • Representation of borrowers and lenders in acquisition and entitlement, construction and permanent loan transactions with local, regional and national lending institutions
  • Substantial experience in all phases of real estate development, including real estate acquisition, land use approvals, development and resale
  • Leasing with significant experience in multi-tenant office lease negotiations as well as retail representation of landlords and tenants in single-tenant "pad", in-line "strip" and "traditional downtown" retail lease negotiations
  • Corporate experience in choice of entity and entity formation matters
  • Representation of landowners, land trusts and governmental entities in more than 70 open space and land conservation transactions
  • Oil, gas and mineral estate transactions and due diligence, including: (i) drafting and negotiating purchase and sale agreements, oil and gas leases, access and pipeline easements, pipeline relocation agreements, and surface use agreements (including directional drilling provisions); (ii) preparing oil, gas and mineral estate owner and lessee title certifications and opinions; and (iii) preparing legal notifications required of surface owners and mineral owners (and lessees) under applicable Colorado statutes
