Jennifer Dukart is a member of Faegre Baker Daniels' litigation group and its nationally ranked products liability area. She focuses on complex litigation and appellate work, with a particular emphasis on pharmaceutical and medical device product liability matters. As a former registered nurse, she brings invaluable knowledge of science and pharmaceuticals to her work on behalf of clients.
Jennifer has experience in both procedural and practical aspects of complex litigation, including class actions. She has conducted numerous depositions and participated in building the scientific and expert witness aspects of pharmaceutical and medical device products liability trials. Her appellate work contributes to her ability to craft and implement winning legal strategies in both trial and appellate courts. Jennifer specializes in novel legal questions, including statutory and constitutional claims. She has contributed to efforts resulting in favorable client outcomes including:
- Expert exclusion briefing that contributed to a dramatic national settlement of more than 120 products liability claims brought against a pharmaceutical manufacturer in numerous state and federal courts before courts ruled on the motions
- Expert exclusion briefing that contributed to a favorable settlement for an herbal supplement manufacturer before court resolution in federal district court
- Dismissal of $1 million default judgment against predecessor corporation, then subsequent fact and expert discovery that resulted in mediated settlement that was characterized by client as a "home run"
- Summary judgment win for a major pharmaceutical manufacturer in a products liability action
- Successful opposition of a motion for preliminary injunction which resulted in a sua sponte dismissal of plaintiff's constitutional claims in federal court in an action brought against government parties and members of the financial services industry
- Successful opposition of motion to expedite appeal in Eighth Circuit that rendered merits of appeal moot
At Faegre Baker Daniels, she has contributed to briefing reviewed by the Supreme Court of the United States, Court of Appeals in the Seventh, Eighth, Ninth, and Federal Circuits, the Minnesota Supreme Court, and the Minnesota Court of Appeals.
