Special Counsel

Lance Lange is a member of the firm's litigation and advocacy group. He has handled lawsuits in the areas of complex commercial litigation, intellectual property litigation, consumer lending and consumer protection litigation, antitrust and trade regulation, appellate litigation, real estate and environmental litigation and corporate internal investigations. While Lance has first- or second-chaired approximately ten jury or bench trials to verdict and handled appeals before several state and federal appellate courts, his cases are often dismissed pre-trial or settled on favorable terms for his clients. Lance is also a member of the firm's national Food & Agriculture industry focus.

His representative experience includes:

Antitrust and FCPA

  • Part of the core trial team for the first consummated merger cases tried in an administrative hearing before the Federal Trade Commission in more than two decades, In re Chicago Bridge & Iron Co., 2004 WL 3142892 (F.T.C. Dec. 21, 2004)
  • Serves as antitrust counsel for a national agricultural trade association
  • Defended an oil industry executive in Foreign Corrupt Practices Act investigations (SEC and DOJ) and litigation
  • Represented national trade association as amicus curiae in successful appeal of the 5th Circuit decision.  See Wheeler v. Pilgrim's Pride, Case No. No. 07-40651 (5th Cir. 2009) (en banc, reversing panel decision)
  • Represented oil services company in grand jury investigation involving allegations involving antitrust violations (no indictments were ultimately issued)

Finance

  • Represented Citi, Wells Fargo Bank, Capital One, Washington Mutual, Centex, Flagstar Bank, Select Portfolio Servicing and other financial institutions in litigation involving various lender liability claims in multiple jurisdictions
  • Managed outside counsel on more than 240 lawsuits (in 25 states) as seconded in-house counsel at a Fortune 100 financial services institution, handling consumer-lending litigation (consumer protection claims, TCPA, RESPA, TILA, FDCPA, etc.)
  • Obtained dismissal of all federal claims in lawsuit brought against CitiMortgage, Inc.  (The lone remaining state claim was later settled.)
  • Represents securities broker-deal in arbitration before FINRA

General Litigation

  • Acted as lead counsel for three national trade associations as amici curiae on briefs filed before the U.S. Supreme Court in National Meat Association v. Harris et al, Supreme Court Case No. 10-224.  The Court granted certiorari and reversed the Ninth Circuit in a 9-0 decision.
  • Represented Microsoft in a lawsuit challenging the validity of the Windows® trademark
  • Represented CEO of a telecommunications company in a shareholder dispute
  • Won a jury verdict as first chair in a personal injury trial involving allegations against a carnival operator
  • Represented several high-net-worth individuals in divorce proceedings and other post-dissolution disputes
  • Obtained a full dismissal of an investigation before the Iowa medical licensing board
  • Represented a central Iowa media organization in a major defamation case
  • Represented individuals receiving Civil Investigative Demands from the FTC as part of an investigation into the practices of a multi-level marketing company

Mr. Lange's cases have been reported in publications such as the Los Angeles Times, the New York Times, the Des Moines Register, SCOTUSBlog, and the National Hog Farmer magazine.
