Counsel

Lucetta Pope represents large corporations, small businesses, government bodies and other entities in civil litigation, focusing on class actions and appeals. 

Lucetta assists clients at every step of the appellate process, from efforts to obtain interlocutory relief to Supreme Court review. She also has substantial experience defending employers in high stakes employment litigation and has been recognized for her effectiveness in legal writing.

Before joining Faegre Baker Daniels in 1995, Lucetta practiced commercial litigation at Mayer, Brown & Platt (now Mayer, Brown, Rowe & Maw) in Chicago.

  • City of Kokomo v. Pogue, --N.E.2d--,  34A02-1003-MI-356 (Ind. Ct. App., 2010) — Appellate counsel for city and common council in interlocutory appeal of trial court denial of motion to dismiss remonstrance petition contesting proposed annexation.
  • In re FedEx Ground Package System, Inc. --- F. Supp.2d ----, 2010 WL 5094230 (N.D.  Ind.), 160 Lab.Cas. P 35,849, 17 Wage & Hour Cas.2d (BNA) 129 — Counsel focusing on cross-motions for summary judgment in Indiana class action joined with other actions in MDL involving claims that drivers were erroneously classified as independent contractors.
  • Hatch v. Teachers Credit Union, Slip Op., Cause No. 64D05-0911-CT-12010,  Porter Superior Court (June 2, 2010) — Counsel in putative class action involving repossession practices.
  • Welch v. Eli Lilly & Co. Slip Copy, 2009 WL 2461119 (S.D. Ind., 2009) — Counsel in nationwide putative class action alleging race discrimination.
  • Schaefer-LaRose v. Eli Lilly and Co., 663 F.Supp.2d 674 (S.D. Ind., 2009) — Counsel in nationwide collective action involving claims that employer misclassified sales representatives under the Fair Labor Standards Act.
  • Chicago Title Ins. Co. v. Gresh, 888 N.E.2d 779 (Ind. Ct. App., 2008) — Appellate counsel for title company in class action brought by home owners alleging unjust enrichment, statutory conversion and violations of the Deceptive Consumer Sales Act.
  • Trail v. Boys & Girls Club of Northwest Indiana, 845 N.E.2d 130 (Ind. 2006) — Counsel for club and individually named directors in defense of tortious interference and defamation action, arguing case to the Indiana Supreme Court.
  • Fuesting v. Zimmer, Inc., 421 F.3d 528 (7th Cir. 2005) — Appellate counsel for medical device manufacturer in challenge of jury verdict on product liability claim.
  • Northern Electric Co., Inc. v. Torma, 819 N.E.2d 417 (Ind. Ct. App. 2004) — Appellate counsel in challenge of judgment denying trade secret misappropriation and conversion claims against former employee following bench trial.
  • Plan Administrative Agent v. New NGC, Inc. et al., Adversary Proceeding No. 02-04166 (N.D. Tex. Bankruptcy 2004) — Counsel in $20 million trade secret misappropriation action arising from bankruptcy of leading distributor of building products for manufactured housing and recreational vehicle industry.
