Lynn Kornfeld is a partner in the Denver office of Faegre Baker Daniels, and specializes in environmental transactional and compliance matters. Ms. Kornfeld has represented major multi-national corporations in resolution of a broad range of issues arising under federal schemes of the Clean Water Act (CWA), Resource Conservation and Recovery Act (RCRA), and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). She has also represented a number of large commercial and industrial clients in contaminated property issues throughout the United States, including: assisting with environmental due diligence; advising on the appropriate allocation of environmental liabilities; negotiating and drafting of purchase and sale, lease, remediation and other agreements; developing appropriate deed restrictions and environmental covenants; negotiating No Further Action and other agency approvals/assurances; and procuring adequate financial assurances.

Ms. Kornfeld's specific experience includes:

• Providing counsel to oil and gas companies on Clean Water Act permitting issues related to the discharge of coalbed methane produced water 
• Providing counsel to clients on a variety of administrative, transactional and litigation matters relating to current and former hard rock mining projects 
• Advising a broad array of chemical, industrial, mining and mineral processing, and waste management facilities located throughout the United States on issues relating to water quality permitting, and hazardous waste treatment, storage and disposal 
• Representing a broad range of clients a broad range of construction-related entities in enforcement proceedings under the CWA 
• Representing clients in enforcement proceedings under RCRA on the Colorado Hazardous Waste Act 
• Assisting client on obtaining approvals related to the operation of a hazardous waste disposal facility, including a RCRA subtitle C permit and a radioactive materials license 
• Assisting with regulatory compliance audit and training programs for large national and multi-national companies with environmental concerns under the CAA, CWA, EPCRA, FIFRA, and RCRA 
• Providing counsel to a broad range of industrial and commercial clients related to the purchase and sale of contaminated properties, including the cleanup of brownfields under the State Voluntary Cleanup Program 
• Participated in the siting and zoning of non-hazardous waste transfer stations, recycling facilities, and other industrial projects 
• Represented a large national company in settlement of a major multi-media enforcement action involving allegations of violations under the CAA, CWA, EPCRA and RCRA 
• Represented a large utility company in resolution of multi-million dollar enforcement action under the CAA's New Source Review (NSR) / Prevention of Significant Deterioration (PSD) programs.

Prior to joining the firm, Ms. Kornfeld worked for the Denver and Washington D.C. offices of the law firm of Patton Boggs, LLP, where she practiced in the administrative/regulatory and environmental policy groups. During law school, she held a clerkship with EPA's National Enforcement Investigation Center and the Colorado Attorney General's Office, where she authored a report on the development of appropriate standards for state environmental prosecutorial authority for the National Association of Attorneys General. Before practicing law, Ms. Kornfeld worked as an environmental consultant for a large construction engineering firm where she provided a broad range of litigation support and technical environmental services to clients, focusing on CERCLA cost recovery and construction claims analyses.
