Maureen M. Maly

Partner

Maureen Maly leads one of the largest ERISA, benefits and executive compensation groups in the country. Her practice focuses on employee benefits, with a particular expertise in health and welfare benefits issues. Maureen regularly helps companies design cost-effective health and welfare programs, while minimizing legal risks and administrative complications. She develops an understanding of the client's employee benefits history, structure, and strategy, and strives to exceed expectations of high-quality, practical, efficient and responsive employee benefits counsel. Maureen is the editor of and a frequent contributor to Faegre Baker Daniels' health care reform blog.

Representative Engagements

Welfare Plans

  • Prepared risk assessment for Fortune 500 employer seeking to reduce retiree medical obligations, including extensive review of collective bargaining agreements, plan documents, summary plan descriptions and other employee communications
  • Negotiated and reviewed multimillion dollar outsourcing agreements for administration of employee benefits for two Fortune 500 clients
  • Redesigned all benefit plans for Fortune 100 employer, including redesign of welfare and fringe benefit programs and consulting on plan design and implementation and employee communications, enrollment materials, summary plan descriptions and forms

Health Reform

  • Advising numerous employers on reporting and disclosure obligations, compliance obligations and potential penalties, including advising on essential health benefits, actuarial value and other insurance market reforms
  • Helping numerous employers determine how ACA's "pay or play" penalties may affect their workforce
  • Helping numerous employers evaluate their options for joining a private exchange
  • Assisting many employers in revising or terminating existing retiree medical plans, due to the availability of insurance exchanges for coverage, and no ACA penalties for failure to offer retiree coverage
  • Advising employers on collective bargaining obligations and language to address ACA contingencies
  • Helping a health care system determine how its new ACO networks can be used under its health plans in compliance with ERISA
  • Advising health insurers regarding impact of HIPAA on insurance exchange participation
  • Advising employers and staffing agencies on ACA compliance for nontraditional workforces

HIPAA Privacy and Security

  • Serve as national HIPAA privacy and security counsel for several Fortune 500 employers
  • Counseled Fortune 100 company through OCR HIPAA audit of group health plans
  • Counseled large insurance company on application of HIPAA privacy and security rules to long-term care insurance products
  • Assisted numerous clients with privacy and security breach incidents, designing and implementing HIPAA training programs, negotiating business associate contracts, and drafting detailed HIPAA privacy and security compliance policies and procedures
