Rick Reichstein has been involved in all aspects of commercial and residential real estate, including purchase and sales, entitlement, development, common interest communities, leasing and financing.

In the area of purchase and sales and development, Rick has represented buyers and sellers in all phases of real estate purchase and sales transactions, including preliminary negotiations, the drafting and negotiation of contracts, common area and easement agreements, review of title and surveys, resolution of title defects, annexation agreements, agreements with services providers, subdivision improvement agreements, development agreements, construction agreements, common interest community formation and review, sale and leaseback transactions, documentation and closing.

Representative transactions in this area in which Rick has had primary responsibility include:

  • Representation of the largest homebuilder in Colorado in: (i) purchases of vacant land and entitlement of same; (ii) purchases of vacant, entitled lots and subdivisions, and purchases of vacant, entitled and fully finished, ready-to-build lots in subdivisions; and (iii) sale of vacant land, entitled lots and fully finished, ready-to-build lots
  • Representation of developers in the sale and acquisition of vacant land, entitled lots and fully finished, ready-to-build lots
  • Representation of purchasers and sellers in the purchases and sales of office buildings, industrial buildings, retail shopping centers and mixed-use assets
  • Representation of owners in the preparation and negotiation of construction contracts and AIA contracts
  • Extensive experience in analyzing and addressing real estate survey and title issues
  • Experience in review and analysis of oil, gas and mineral rights and ownership, leasehold and other interests arising in connection with the purchase and sale of real property
  • Experience in oil and gas drilling and division order title opinions in Colorado and outside of Colorado and curative work in connection with oil and gas title opinions
  • Representation of owners in connection with purchasing, selling and leasing of mineral interests
  • Representation of owners in the creation of office condominium and conversion projects, residential condominium formation and conversion projects
  • Representation of owners' associations ongoing corporate governance, CCIOA compliance, transition from Declarant control and amendments to condominium governing documents

In the area of commercial leasing, Rick has extensive experience representing both landlords and tenants in the negotiation and drafting of office, industrial, medical and retail leases. He also assists owners of office, industrial and retail properties with ongoing management issues, such as assignment and subletting, changes in use, construction of tenant improvements, tenant defaults and property damage and insurance issues.

Representative transactions in this area in which Rick has had primary responsibility include:

  • Representation of several landlords in the leasing of more than 2 million square feet of office space in the Denver Tech Center, Lakewood, Cherry Creek, Boulder, Denver, Interlocken and Westminster markets
  • Representation of landlords in the leasing of grocery-anchored, strip center and big box retail space in multiple projects
  • Representation of landlords in the leasing of more than 1 million square feet of industrial space in multiple industrial centers
  • Representation of tenants in the negotiation of a long-term lease transactions including: (i) 63,000 plus square foot office building; (ii) 20,000 plus square foot office building in Virginia; (iii) 58,000 square foot office and warehouse building; and (iv) 55,000 plus square foot medical office building

In the area of commercial lending, Rick has substantial experience representing borrowers in obtaining loans secured by real property for project acquisition and development in the following areas:

  • Shopping center and retail
  • Office buildings
  • Mixed use projects
