Sarah McLennan

Associate

Sarah McLennan is a qualified solicitor in England and Wales, and she is an associate in the London finance and restructuring practice.

Sarah focuses her practice in insolvency where she has considerable experience in all aspects of contentious corporate and personal insolvency matters, including administration issues, receiverships and liquidations, and litigation on behalf of insolvency practitioners. In addition to her insolvency practice, Sarah advises businesses, sole traders and companies on a wide range of commercial disputes.

Recent matters include:

  • Assisting on the administration of a major national retailer
  • Advising the directors of a major UK retailer on their duties and placing the company into administration
  • Placing a large UK company into administrative receivership and advising on issues arising during the receivership including retention of title
  • Advising administrators on the validity of their appointment and on the priority and validity of charges
  • Representing a major creditor in the Farepak administration
  • Running a portfolio of debt collection cases in administration of a large private company for a leading set of accountants, with cases ranging in value from £50,000 to £900,000
  • Advice on COMI in respect of a bankruptcy petition served on a European citizen in the United Kingdom who opposes the petition on the grounds of COMI
  • Conduct of a minority shareholder s459 petition in a dispute involving the failure of the company to produce and file accounts or to recognize the minority shareholder's rights, breaches of the director's duties, and the misappropriation and willful neglect of company assets
  • Acting for petitioning creditor on contested winding up petition and the subsequent appeal and making an application for security for the cost of the appeal
  • Advising a German national on entering into an IVA within the jurisdiction of England and Wales and advising the supervisor on location of the meeting of creditors and the EC Regulation on Insolvency Proceedings 2000
  • Advising a contributor to a CVA on the recovery of his contribution pending the failure of the CVA
