Associate

Jessica Faith is an associate in the ERISA, benefits and executive compensation practice. She counsels employers and financial service providers on employee benefits matters, including tax-qualified defined contribution and defined benefit plans — including 401(k) plans, ESOPs and cash balance plans — as well as health and welfare plans and nonqualified deferred compensation plans.

Representative Experience

  • Obtaining favorable determination letters from the IRS on plan amendment, restatement and termination
  • Correcting operational and plan document failures under the IRS Employee Plans Compliance Resolution System (EPCRS) and resolving fiduciary violations using the DOL Voluntary Fiduciary Correction Program (VFCP)
  • Drafting and amending plan documents and trust agreements
  • Responding to benefit claims and appeals
  • Analyzing domestic relations orders for qualified and nonqualified plans
  • Writing summary plan descriptions, summaries of material modification, ERISA 204(h) notices and other participant communications
  • Reviewing administrative service agreements and investment management agreements
  • Advising employers on compliance with the Affordable Care Act

Jessica is a frequent contributor to the Beyond Health Care Reform Blog, where she writes about the latest health care reform issues affecting employers.

Prior to joining Faegre Baker Daniels, Jessica was a law clerk in the Licensing and Administrative Law Division of the Iowa Attorney General's Office. She was a summer associate at the firm in 2008.
