Tom Carroll is a member of the firm's labor, employment and benefits group. He concentrates his practice on employment litigation and counseling. Tom has defended employers before both state and federal courts, as well as before administrative agencies, against claims of discrimination under Title VII and state law, wrongful termination, minimum-wage and overtime violations under the FLSA and state wage laws, and other claims. Tom counsels employers regarding such matters as non-competition agreements, employee classification, and employee hiring, discipline, and discharge, and he helps employers prepare employment agreements, separation agreements, and general employee policies. He has assisted in internal investigations of employee misconduct.
Tom's practice also includes representing clients in general business litigation. His experience in general litigation includes contract disputes, challenges to state agency rule-making and administrative decisions, insurance disputes, and shareholder grievances.
Tom devotes significant pro bono time to veterans and other individuals with a military connection. Through the National Veterans Legal Services Program's Lawyers Serving Warriors project, he has represented veterans in disability proceedings. Tom also participates in Colorado Legal Services' Individuals with a Military Connection project, which provides free legal resources to service members, veterans, and their families. Tom is accredited to prepare, present, and prosecute claims for benefits before the Department of Veterans Affairs.
During law school, Tom interned with the Richmond County District Attorney in Staten Island, New York. He was also a member of the Neighborhood Institutions Clinic at the New York University School of Law, where he participated in wage-hour litigation and provided counseling for non-profit incorporation and tax-exempt status.
