Todd Walker litigates complex commercial matters, specifically including environmental lawsuits, class actions and commercial contract disputes. With more than a decade of pre-law environmental consulting and management experience, Todd is adept at litigating the technical and engineering issues that frequently arise in environmental cases. Todd also has extensive experience defending and defeating certification in putative state and national class action lawsuits for a national insurer.  

Representative litigation experience includes:

  • Defended national energy company in putative class action case while pursuing indemnity claims against former owner/operator concerning groundwater contamination emanating from petroleum refinery. Class certification denied. Indemnity litigation continues.
  • Defended national insurer in putative class action alleging breach of contract and consumer fraud claims. Class certification denied by trial court after evidentiary hearing; decision affirmed on appeal. Reyher v. State Farm Mut. Auto. Ins. Co., 2011 WL 5120836 (Colo. Oct. 31, 2011).
  • Defended global agricultural company against attorney general suit seeking over $1 billion in natural resource damages. Damage claims dismissed on summary judgment. Decision pending on remaining equitable claims after five-month trial.
  • Won seven-figure arbitration award under environmental indemnity provisions of purchase and sale agreement for bulk fuel terminal.
  • Recovered groundwater cleanup costs for developer of large residential & retail brownfield redevelopment project.
  • Negotiated favorable multi-million dollar settlement to recover cleanup costs against former owner/operator of lead smelter in Los Angeles.
  • Defended and defeated certification of putative national class regarding homeowner's insurance claims.
  • Defended insurer to dismissal on summary judgment regarding automobile insurance claims. Defense judgment affirmed in a precedent-setting decision. Stickley v. State Farm Mut. Auto. Ins. Co., 505 F.3d 1070 (10th Cir. 2007).
