Faegre Baker Daniels has one of the nation's preeminent agribusiness finance practices. We represent numerous domestic and foreign commercial banks, cooperative banks and unregulated financial institutions, as well as debt issuers, swap counterparties and other parties in complex agribusiness finance and restructuring matters on a national and international basis.

With more than 200 lawyers and consultants on our financial services industry team and over 150 attorneys on our food and agribusiness industry team, our specialists bring a deep expertise in structuring and negotiating agribusiness financings as well as in workouts, restructurings and litigation for agribusiness matters.

Scope of Practice

Debt Financing

Our team has advised cooperative and commercial banks on billions of dollars of syndicated finance transactions involving sugar, grain, oilseeds, dairy products, fruits and vegetables, and protein. We have also structured and negotiated securitizations and other agribusiness financings to cooperatives, agricultural producers and processors, pesticide and chemical manufacturers, rice companies, dairies, food processing companies and other ag-related borrowers. We understand the unique collateral challenges that accompany lending against agricultural commodities, including complex borrowing bases, forward and futures contracts, commodity account control issues and producer super-priority liens.

Our restructuring team has worked on billions of dollars of bankruptcies, workouts and distressed acquisitions involving protein and grain producers and processors, cooperatives, chemical companies and other agribusinesses. We regularly represent secured and unsecured creditors, debtors, purchasers, committees, indenture trustees, investors and contract counterparties in proceedings ranging from workouts and reorganizations to complex bankruptcies with numerous layers of financing.
