Public Utilities Regulation

Faegre Baker Daniels advises investor- and municipality-owned water, sewer, gas, electric, steam and telecommunication companies, utility customers and trade associations on matters related to complex state and federal utility regulations.

Public-Private Partnerships

We have served as lead counsel on the sale of multiple water and wastewater systems, including the largest water and wastewater system acquisition in U.S. history. Our experience includes lead counsel representations on successful sales for both public and private entities. These engagements include securing various approvals from federal, state and local government.

Indiana Utility Regulatory Commission

We represent telecommunications companies and their customers before the Indiana Utility Regulatory Commission (IURC) and other state governing bodies during:

  • Proceedings seeking IURC approval of a sale of a utility
  • Proceedings for authority to provide services or to seek exemption from IURC jurisdiction
  • Proceedings to determine the extent of regulation of telecommunications service providers
  • Financings and rulemaking proceedings
  • Proceedings to implement the Telecommunications Act of 1996

IDEM, PUC, FERC, EPA and Courts Interactions

Additionally, we represent all types of utilities clients in interactions with the Indiana Department of Environmental Management (IDEM), Minnesota Public Utilities Commission (PUC), Federal Energy Regulatory Commission (FERC), EPA, and federal and state courts. We have served as lead counsel during many utility regulatory proceedings and represented clients in court appeals of administrative orders.

Our professionals work with members of Congress and state legislatures to shape laws governing utilities and assist clients in influencing rate and rulemaking proceedings of regulatory bodies.
