Patrick J. O'Connor, Jr. of Faegre Baker Daniels is co-chairing Practising Law Institute's Building Better Construction Contracts 2012 on Tuesday, September 18. He also is speaking on "Managing Risk Through Insurance Bonding: New Developments" during an afternoon session.
Also speaking at the afternoon session of the one-day seminar is Peter C. Halls of Faegre Baker Daniels on "Managing Delay and Disruption Claims Through Contracts." The program will be presented on location in New York City and via live webcast.
The seminar will provide the tools needed to better negotiate and draft design and construction agreements. Participants will learn which risk allocation clauses work and under what circumstances—including the so-called "killer clauses"—as well as which more often prove counterproductive.
Speakers also will examine new collaborative contracting models such as Integrated Project Delivery (IPD), allowing a choice of which aspects of these agreements might assist clients. The seminar will also look at how to best leverage new technologies such as Building Information Modeling (BIM) to achieve better project outcomes. Participants will also learn what risks are best handled through insurance and how to draft state-of-the-art insurance and indemnity provisions, including those for such integrated programs as Owner-Controlled Insurance Programs (OCIPs). Innovative dispute resolution approaches will be examined, too.
