Overview

Managers often assume they are free to devise various tests to evaluate suitability for roles, or readiness to return to a role following a period of leave. These exercises may take the form of:

  • Math and reading comprehension tests
  • Physical “fitness for duty” tests
  • Task simulation
  • Personality or psychological test
  • Language proficiency tests

Such screening procedures can place the employer at risk of discrimination claims, including claims of discrimination based on disability — an area of law that’s a current  “hot topic” for EEOC enforcement.

An application for standard Colorado, Indiana and Minnesota CLE credit will be submitted. The program will also be submitted to the HR Certification Institute (HRCI) and the Society for Human Resource Management (SHRM) for continuing education credit review.
