Juries continue to hand down surprising verdicts in publicity and privacy cases: from $8.9 million to Michael Jordan for a right of publicity claim against a grocery store to a stunning $140 million to Terry "Hulk Hogan" Bollea in his privacy case against Gawker. And while there are now at least five different tests for evaluating First Amendment defenses in this area, the Supreme Court recently turned down the opportunity to clarify things - denying a petition for certiorari in Electronic Arts v. Davis. Join us as we consider the latest developments in this increasingly risky area.
