Brian Garrison in Indiana Lawyer on the Demise of Right-to-Work in Indiana

Two Lake County judges over as many years have ruled that Indiana's right-to-work law (RTW) violates a provision in the Indiana Constitution. In July 2014, Lake County Judge George Paras struck down RTW on the basis that it is unconstitutional. In September 2013, another Lake County judge issued a similar decision in a different case.

Brian Garrison, partner in Faegre Baker Daniels' Indianapolis office who concentrates his practice in the counseling and representation of management in labor relations and employment matters, spoke to Indiana Lawyer about the rulings. Garrison said that while proponents of RTW expected legal challenges, it was a surprise to most that the law was found unconstitutional.

"While the challenge was anticipated," Garrison said, "I don't think it was anticipated that the law would be found to be unconstitutional."
