What is Acceptable ‘Wear and Tear' in a Commercial Lease?

What constitutes “normal wear and tear”? For a party terminating a commercial lease, the definition of that phrase—which varies from state to state—can be the difference between a clean parting and lease litigation. In an article written for Law360, Faegre Baker Daniels partners Karen Moses and Carl Pebworth outlined “six actions a contracting party can take to ensure that lease termination does not result in lease litigation."

“An ounce of proactive attention to these issues can save pounds of costs and inconvenience at lease termination,” they wrote.
