Gregory Dale Quoted in Safety and Health Magazine About Employee Drug Testing

In an article for Safety and Health Magazine, Faegre Baker Daniels partner Gregory Dale discussed what the Occupational Safety and Health Administration (OSHA) wants to achieve with employer drug-testing policies amidst recent modifications that ban mandatory post-incident drug testing programs as a means of retaliation.

“The comment that OSHA gave is employers don’t need to specifically suspect drug use before testing, but there should be a reasonable possibility drug use was a contributing factor, so it does introduce a reasonable suspicion element,” said Dale.
