Scott Bialecki draws from more than two decades of legal and regulatory experience to help clients build and protect their businesses both domestically and abroad. Although he specializes in intellectual property litigation, he also provides outside general counsel services, leveraging the firm’s depth to assist clients with legal needs in corporate, antitrust, government contract, employment and real estate contexts. A former regulator with the Federal Trade Commission (FTC) and a registered patent attorney, Scott is uniquely positioned to provide intellectual property and regulatory counsel to companies introducing products and services into the marketplace. Having conducted business in Asia for a number of years, Scott advises Asia-based clients on the intricacies of U.S. law and counsels companies seeking to pursue business ventures in Asia.

Intellectual Property Litigation

Scott files and defends against lawsuits in federal courts throughout the country involving patent, trademark, trade dress, and copyright infringement, trade secret, unfair competition, anti-cybersquatting, counterfeiting and/or deceptive trade practices claims. He provides pre-litigation counseling, assisting with developing non-infringing designs and evaluating the use of litigation alternatives, such as inter partes review proceedings and ex parte reexaminations.

Advertising and Consumer Protection Counsel

Along with his IP litigation counsel, he provides legal guidance on advertising issues, including evaluating endorsement and efficacy claims and orchestrating clinical trials. Drawing from the consumer protection and antitrust expertise he gained in his years as a regulator, Scott is a trusted strategist for companies in their interactions with government agencies, including the U.S. Patent and Trademark Office, FTC, National Advertising Division and National Advertising Review Council.
