Overview

Jim has defended clients in complex litigation for more than three decades, serving as national counsel, first- and second-chair trial counsel, work-up counsel, and in a variety of additional roles. He is skilled in managing fact and expert depositions, expert development and Rule 702 strategy. Jim’s clients have included some of the world’s largest multinational companies in the health and life sciences sector, technology enterprises, food and confectionary businesses, as well as individuals. As a former assistant U.S. attorney, Jim leverages his experience — particularly trial experience — to provide clients comprehensive advice and representation in sophisticated product liability matters.

Jim is also the co-chair of the health and life sciences segment of Faegre Drinker’s artificial intelligence and automated decision-making (AI-X) team, an interdisciplinary group of attorneys, consultants and in-house data scientists who:

  • advise clients on emerging laws, regulations and industry standards relating to AI technologies
  • help clients develop responsible AI governance models
  • counsel on regulatory compliance, best practices, risk management and risk allocation related to these technologies
  • help clients to leverage, license and protect proprietary data and models
  • provide effective advocacy when litigation involving these technologies arises

The AI-X team’s health and life sciences segment brings this holistic approach and deep industry understanding to assist clients on issues related to artificial intelligence, machine learning, Big Data and automated decision-making. These technologies are transforming health care, and the AI-X team helps clients innovate in this space, wherever they are in their journey.

Product Liability & Mass Torts

Since entering private practice, Jim has focused on the defense of health and life sciences companies — particularly pharmaceutical and medical device manufacturers — in product liability litigation. He has represented clients in single-plaintiff actions, mass actions and MDLs. Covering a range of pharmaceutical products and medical devices, Jim’s experience includes blood products and factor concentrates, diet drugs, hormone therapy, antibiotics, anticoagulants, and a variety of orthopedic medical devices.

In addition, Jim represents food and confectionary companies in product liability litigation, including consumer fraud and consumer class actions in state and federal courts.

Consistent with his concentration in technology / artificial intelligence, Jim also defends technology companies in personal injury and product liability cases around the country.

Additional Litigation Experience

  • A decade defending individual health care providers and institutions in professional liability matters including all aspects of litigation such as discovery, trial and appeal.
  • The defense of residential property owners in toxic tort cases alleging childhood brain injury from exposure to lead-based paint.
  • Prosecuting complex antitrust suits involving claims challenging pharmaceutical contracting practices.
  • Defense of an international charitable foundation against claims related to human medical experiments conducted in Central America in the 1940s.

Personal Interests

An avid cyclist and triathlete, Jim also enjoys rock climbing and exploring the outdoors with his wife and three adult children.
