Dan Kelley helps clients resolve high-stakes business disputes by aggressively litigating to facilitate the best possible outcome, whether at trial or in settlement. He focuses his practice on litigation involving securities and trade secrets, and on white collar defense and investigations.
Dan practices before state and federal courts and arbitration panels. He has:

  • Examined and cross-examined fact and expert witnesses
  • Taken and defended the depositions of key witnesses
  • Managed complex e-discovery involving millions of documents
  • Argued appeals

Securities & Financial Litigation

Dan has been the lead associate in multiple state court cases and FINRA arbitrations, defending clients in cases involving allegations of:
  • Negligence and fraud
  • Breach of fiduciary duty or contract
  • Unsuitability
  • Improper solicitation
  • Failure to conduct proper due diligence

Past Experience

Before joining Faegre Baker Daniels, Dan worked as a litigator with Jenner & Block LLP in Chicago. Before law school, Dan taught social studies and coached wrestling for two years at an under-resourced rural public school as a member of Teach for America in Eastern North Carolina.

Leadership & Community

Pro Bono

  • In the closing days of the Obama administration, obtained asylum and dismissal of removal proceedings for undocumented Salvadoran minor.
  • Represented disabled Social Security beneficiary in successful challenge of denial of claim for benefits, resulting in remand from federal court to Administrative Law Judge, and subsequent fully favorable decision from ALJ on beneficiary’s benefits claim. 
  • As appointed counsel for formerly pro se litigant in the Southern District of Indiana’s Mediation Assistance Program, secured favorable settlement for former prisoner in § 1983 suit against prison guards for failing to prevent attack from fellow inmate. Successfully moved for modification of client’s sentence, allowing him to serve the balance of sentence in a re-entry program.
  • Represented citizen alleging local school board’s violation of his First Amendment rights.
