Overview

Kent Richey is one of the nation's leading Indian Country business and finance attorneys. A former business litigator and bond and underwriter's counsel for tax-exempt and taxable governmental financings, Kent represents a variety of clients, including banks, investment banks, broker-dealers, insurance companies, credit enhancers, equipment vendors, casino developers, consultants, managers, and Indian tribes and their instrumentalities.

The interplay of Indian law, commercial law and securities law presents specialized challenges that Kent meets efficiently on a cost-effective basis through his broad, practical knowledge of Indian country. Drawing on his public finance background, he recognizes the critical role tribal governments and their members play in negotiating Indian commercial transactions.

Indian Country Financing and Transactions

More than 90 Indian tribes throughout the country have been involved in Kent's transactions. He has worked on bank loan and credit facilities (syndicated and non-syndicated), leases (financing and operating), and the offer and sale of indentured debt securities, among other financing structures. Such financings have involved senior debt, subordinated debt, credit enhanced debt, participating or continent interest debt, and transactions with interest rate protection or swaps.

Tribal Debt Restructuring

Kent is an authority on restructuring of tribal debt. He represents clients in connection with a defaulted tribal commercial loans and bond issues undergoing restructuring efforts. Kent collaborates with senior legal and other staff of the National Indian Gaming Commission to explore new approaches to enable restructurings and restore investor and lender confidence in tribal financings. He is in frequent contact with the National Indian Gaming Commission or the Bureau of Indian Affairs.
