John Schlafer is a trial lawyer, regulatory advisor and risk manager for product manufacturers.

Product Liability Litigation

John tries product liability cases in state and federal courts around the country. He has defended manufacturers of medical devices, consumer products, and mechanical and industrial products.

John has extensive experience in litigating mass torts, including federal MDLs and their state analogues. He has experience with all facets of complex, mass torts, including e-discovery, large case pools, international service and discovery, jurisdictional questions, international regulations, and complex scientific evidence. John applies legal process improvement training and process management experience to run large litigation efficiently and cost effectively for clients.

Regulatory Compliance

John advises companies on federal, state and local consumer products regulations and represents companies before federal and state regulatory agencies. He both acts as outside risk management and compliance counsel for clients without dedicated in-house lawyers for the role and advises large companies with dedicated staff on more complex issues.

John advises clients on regulations established by:

  • The Consumer Product Safety Commission,
  • The Federal Trade Commission
  • The California Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation
  • The Model Toxics in Packaging Act
  • The Fair Packaging and Labeling Act
  • State stuffed goods laws
  • State green chemistry laws
  • California Proposition 65

John helps clients develop internal procedures and protocols, comply with reporting obligations, implement and manage recalls, and respond to notices of non-compliance, letters of advice and reports to SaferProducts.gov.

Risk Management Counseling

John combines his litigation and regulatory experience to advise clients on risk management issues for consumer and mechanical products. He consults on best practices for new product development, advises on warnings, instructions and labeling, develops safety and quality testing protocols, and applies applicable industry consensus standards.
