Ebony C. Smith is a watchtower in the realm of labor and employment. With an eye to the changing regulatory landscape, Ebony helps marshal clients through their most challenging workforce issues. She has practical experience working with public and privately held companies across the consumer services sector, and she has supported clients before administrative agencies and in federal and state court.

Dynamic Trial Support

Ebony’s strength is in her painstaking approach to prep work. She is particularly skilled at:

  • Shoring up position statements for claims filed with the Equal Employment Opportunity Commission (EEOC), the Illinois Department of Human Rights, and Office for Civil Rights (OCR).
  • Drafting discovery-related motions, motions to dismiss, and motions for summary judgment.
  • Preparing pretrial submissions, including jury instructions and the statement of case, as well as motions in limine.
  • Conducting and supervising electronic discovery.

In-Depth Employment Counseling

Ebony is a trusted advisor on trending and emerging issues in labor and employment, including compensation and benefits, paid family leave requirements, corporate immigration, timekeeping technologies, “ban the box” initiatives, and employee vs. independent contractor designations. She has also led harassment trainings specifically focused on the #MeToo movement and racial discrimination, and she has counseled clients on policy developments surrounding gender pay equity.   

Drawing on her background in trial and appellate clerkships, Ebony works with employers to manage litigation risk, respond to disputes, and conduct internal investigations – specifically into discrimination and breach of fiduciary claims.  

Past Experience

In addition to judicial clerkships, Ebony worked as a contract evaluator and clerked with a Chicago law firm before joining Faegre Baker Daniels. She also completed a trade and investment internship with the British Consulate General and served as a research assistant on international issues during law school.
