Overview

Mark Yaskanin helps clients improve their position in the marketplace through strategic intellectual property counsel. Mark supports clients on wide-ranging patent issues, including counseling clients on high-level intellectual property issues and executing more specific priorities, such as procuring patent protection for his clients, assisting with asserting patents and defending against patent litigation. Accordingly, Mark develops strategies that not only address his clients' patent portfolios, but also prepare challenges to adverse entities, including preparing third-party preissuance submittals to place references before the United States Patent & Trademark Office (USPTO), thereby assisting with blocking competitors' patent applications from ever being granted as patents.
Mark also prepares non-infringement/invalidity opinions and performs transactional due diligence, including patentability searches, patent application file history, and relevant prior art review and claim analyses. He also counsels clients through post-grant patent invalidation efforts, and assists clients as they consider licenses and purchase agreements, as well as product development and distribution agreements.

Technical Expertise

With a background as a licensed professional engineer and certified professional geologist, Mark brings an in-depth understanding to the challenges innovators face in cultivating and protecting intellectual property. 

In his legal practice, he has particular experience in:
  • Medical devices and technology; 
  • Energy-related systems and improvements, including hydraulic fracturing and other oil and gas well-related inventions;
  • Engineered materials. 
  • Tools and other mechanical devices and systems.
