Global Employer Defeats Class Certification, Prevails in Individual Plaintiff Jury Trial

United States - Indiana

In March of 2011, our firm successfully defeated class certification in putative nationwide class of current and former employees alleging race discrimination against a global employer. The case continued as multiple ongoing cases.

In a named plaintiff’s individual case, our employment litigation team prevailed in a six-day jury trial in Indiana on the issues of whether the company discriminated against the plaintiff because of her race, subjected her to racial harassment, and terminated her in retaliation for complaints of racial discrimination.

The Federal Court Judge’s decision was affirmed by the 7th Circuit Court of Appeals in December 2014.
