Faegre Baker Daniels was lead counsel for the defendant Cargill. The plaintiffs brought suit against Cargill for fraud, violation of the Tennessee Consumer Protection Act, Tenn. Code Ann. § 47–18–104 (TCPA), and a declaration that the parties’ contracts were void. Cargill filed a Motion to Stay and Compel Arbitration. In response, the plaintiffs alleged violations of the Commodities Exchange Act (CEA), 7 U.S.C. § 25, and Commodities Futures Trading Commission Regulations. After carefully reviewing the contracts at issue and the arguments, the Court rejected the plaintiffs’ claim that the contracts violated the CEA and compelled arbitration.
