National Bank Prevails in Foreclosure Appeal

North America - United States | North America | United States - Indiana

A national bank sought to foreclose on a mortgage lien over the same property on which a construction company held a mechanic's lien. The trial court ruled in favor of the national bank. In October 2014, the trial court amended its previous order and granted summary judgment in favor of the construction company.

The bank successfully appealed this ruling in June 2015, and it was ruled that the construction company's mechanic's lien was junior to the bank's mortgage lien. Our firm served as appellate counsel for the national bank in relation to this appeal.
