Iowa Renewable Energy Obtains Complete Dismissal of Lawsuit by Tender Offeror Seeking to Compel Transfer

Iowa Renewable Energy (IRE) and IRE’s officers and directors defended against a lawsuit brought by REG Washington, LLC (REG), a subsidiary of Renewable Energy Group, Inc., seeking to compel transfer of membership units as to which REG had made a tender offer. In a novel decision, the Court dismissed the claims with prejudice and held that IRE had the right to refuse to approve the transfers.
