Regulatory

Faegre Baker Daniels' national environmental regulatory practice provides clients with a coordinated approach to meeting their environmental legal needs. The environmental regulatory team counsels clients on matters across all environmental media and related statutes—the Clean Air Act, Clean Water Act, RCRA, CERCLA, TSCA, NEPA and Endangered Species Act, to name a few—addressing legal and business needs related to manufacturing, energy, oil and gas, mining, electricity, renewable energy and public lands. Litigation

The firm's environmental litigation lawyers bring breadth and depth of experience to environmental and toxic tort litigation throughout the country. Our lawyers have handled environmental cases in federal and state courts nationwide. We develop and implement strategies commensurate with the risk and business objectives of a particular litigation, including trying the case.

Our experience includes Superfund cost recovery and contribution, natural resource damages, review of agency decisions, toxic torts, enforcement actions, citizen suits, environmental review and private contractual indemnity claims. We draw on the strength of our environmental regulatory and compliance practice, and have extensive relationships with consulting and testifying experts in support of the litigation and regulatory practices. Cost-conscious, we recognize that litigation can be enormously expensive, and work with clients and vendors to identify, evaluate and implement cutting-edge tools to manage these tasks. We also have substantial experience with alternative dispute resolution tools in lieu of or in tandem with litigation.

Transactional

Our team advises clients on complex transactions involving contamination and environmental compliance issues. Our lawyers are at the forefront of establishing state and national brownfields redevelopment programs. We advise clients on applicable cleanup liability defenses, the development of agreement terms and other instruments to mitigate risk, including the use of voluntary cleanup programs, the negotiation of cleanup closures and no-liability assurances from agencies, and the procurement of environmental insurance or other financial assurance mechanisms that permit development projects to move forward with an appropriate level of investigation and cleanup. We have comprehensive experience in federal, state and local environmental regulatory programs and we routinely assist clients in permitting and other regulatory compliance issues associated with corporate and real estate transactions. Through our teams of skilled lawyers, potential environmental problems are identified, clarified and solved so that real estate and corporate transactions move forward expeditiously and cost-effectively. 

Federal Affairs
