Sylvia Bokyung St. Clair

Sylvia St. Clair is a member of the firm’s labor and employment group. She represents employers in lawsuits in federal and state court, and local, state and federal administrative agencies throughout the United States in complex employment cases arising under Title VII, Fair Labor Standards Act (FLSA), Family and Medical Leave Act (FMLA), and a host of other state and federal laws.

Sylvia regularly represents employers in administrative proceedings before the Equal Employment Opportunity Commission (EEOC) and state civil rights commissions or fair employment practice agencies.

Sylvia assists her clients to avoid employment litigation and evaluate and minimize risk of their employment-related claims, including claims of unlawful discrimination, harassment and retaliation, other statutory claims, and common law torts. She has developed effective handbook policies, best practices for workforce performance management, and drafted, interpreted and negotiated employment agreements, including transition and separation agreements, employee retention agreements, and confidentiality and non-competition agreements.

Representative Experience

  • Defending retail employer against EEOC’s systematic investigation into employer’s leave and disability policies pursuant to Title VII involving more than 1,500 retail stores
  • Defending nationwide furniture store against allegations sexual harassment and retaliation by her supervisor pursuant to Title VII and Illinois Human Right Act, and Illinois tort claims
  • Defending international manufacturer company employer against allegations of hostile work environment based on her reverse discrimination because of race, ancestry (language skills) and national origin pursuant to the California Fair Employment and Housing Act (FEHA)
  • Defending environmental services employer against allegations that the employee was retaliated against for taking military service-related leave pursuant to USERRA
  • Defending hotel employer against class action wage and hour lawsuit alleging violations of FLSA and Illinois Minimum Wage Law (IMWL)
  • Defending apartment complex employer against allegations of sex-gender discrimination and same-sex discrimination

In addition to labor and employment, Sylvia’s experience includes defending her clients in premises, commercial, product liability, toxic tort and transportation matters. She has defended manufacturers, suppliers, service providers and employers against allegations of personal injury, catastrophic loss and other types of exposure claims.

Sylvia is well versed in all stages of discovery and litigation. She has handled and supervised complex litigation discovery, including electronic stored information (ESI). She secured a non-guilty verdict on behalf of a truck driver in a motor vehicle collision involving a casualty and significant property damage.

Prior to attending law school, Sylvia enjoyed a decade-long career in hospitality (hotels, restaurants and a race track) operations and management where she developed standard operating procedures and guest services’ excellence standards. She and her staff were widely recognized for outstanding guest services scores and guests’ loyalty. Sylvia oversaw new hotel openings, brand transitions and seasonal closings.

Since 2015, Sylvia has served as a Board of Director for the Women’s Bar Foundation, an organization that awards scholarship money to third-year female law students who demonstrate academic excellence and a commitment to community and diversity. As a former recipient herself, Sylvia dedicates her time to mentoring female law students and is committed to advancing opportunities for other female diverse legal professionals. She is the first member of her family to attend college and law school.

  • Northwestern Pritzker School of Law, Illinois Coalition for Fair Sentencing of Children — Successfully obtained a new resentencing hearing for an individual serving a mandatory life-without parole sentence pursuant to the Illinois Supreme Court’s holding in People v. Addolfo Davis that the prohibition of mandatory life sentences for homicide offenses committed by juveniles would apply retroactively
  • National Immigrant Justice Center, Deferred Action Clinics — Assisted an immigrant youth who arrived to the United States during her childhood in completing and filing an application for deferral and work permit
