Stephen A. Kubiatowski, a former federal prosecutor and official with the U.S. Department of Justice (DOJ), has joined Faegre Baker Daniels’ business litigation group as a partner where he is focusing his practice on white collar criminal defense. He is also part of the firm’s health and life sciences industry team. He will be resident in Washington D.C., and will also work out of the firm’s Chicago office.
Kubiatowski draws on his nearly 20 years’ experience in government to help corporate and individual clients prevent and defend against litigation and government investigations, particularly in the fields of health care and financial regulation. He also uses this experience to advise businesses on developing and implementing compliance programs; conducting internal investigations; and assessing criminal, civil and administrative liability.

Prior to joining Faegre Baker Daniels, Kubiatowski served as federal prosecutor with the United States Attorney’s Office for the Northern District of Illinois (2001-11), and with the United States Attorney’s Office for the Central District of Illinois (1997-2001). He also served as Health Care Fraud and White Collar Crime Coordinator in the Executive Office for U.S. Attorneys, where he worked closely with DOJ leadership and law enforcement agencies to develop and implement new policies governing the prosecution of health care fraud and white collar crime, including matters impacting the Affordable Care Act.

Kubiatowski has significant expertise in health care compliance, fraud and abuse matters, particularly those involving the False Claims Act. At the DOJ, he investigated and/or prosecuted more than 50 False Claims Act cases, including qui tam filings, involving pharmaceutical companies, medical device manufacturers, nursing homes and other health care entities. His handling of these matters resulted in the recovery of millions of dollars for the Medicare and Medicaid programs.
In addition to his courtroom accomplishments, Kubiatowski supervised hundreds of investigations and prosecuted a wide array of white collar criminal matters, including health care fraud, bank fraud, securities fraud, commodities fraud, tax evasion and public corruption. He has handled matters involving the Federal Bureau of Investigation, Internal Revenue Service, the U.S. Securities and Exchange Commission and U.S. Commodity Futures Trading Commission.
Kubiatowski graduated from Columbia University School of Law where he was a Harlan Fiske Stone Scholar and managing editor of the Journal of Transnational Law. He received a bachelor's degree from Dartmouth College, summa cum laude and Phi Beta Kappa.
