Gary Weinstein and Tim Sullivan Offer Insight to Minnesota Lawyer on Forum-Selection Clauses

During the final months of 2013, the U.S. Supreme Court decided several cases signaling that the Court will continue to take forum-selection clauses seriously. Faegre Baker Daniels intellectual property attorneys Gary Weinstein and Timothy Sullivan authored an article appearing in Minnesota Lawyer on how best to avoid being pulled into an undesirable forum in a patent-infringement case.

Weinstein and Sullivan stressed that when planning to file a suit surrounding patent-infringement claims, one must review all applicable contracts to determine if any contracts contain forum-selection clauses. Depending on the language in the contracts, the contracts may be a useful tool to for getting into, or out of, a particular venue.
