Overview
Jessica Barth possesses broad and deep healthcare experience and a practical, results-oriented approach. Leveraging a 13-year tenure as chief counsel at Eskenazi Health — one of the largest public health systems in the United States — Jessica counsels hospitals, health systems and individual providers, as well as companies involved in the development of pharmaceuticals and medical devices, on a wide range of regulatory and compliance matters, including fraud and abuse, facility and individual licensure requirements, privacy, and EMTALA. She also has extensive experience drafting and negotiating healthcare-related contracts such as healthcare professional services agreements, clinical trial agreements, supply chain agreements and grant agreements.
Jessica strives above all to avoid risk and to identify and correct potential problems before they emerge. When a crisis does arise, Jessica takes a calm, measured and practical approach developed over years of daily crisis management.
Jessica understands that health care companies must adapt constantly to a changing environment, and she can provide guidance to find the right path forward, whether the change is necessary to better serve patients or to comply with regulatory and accreditation standards.
Experience as General Counsel
- Managed all legal aspects of the construction of a new $754 million hospital campus, including a successful public referendum; the structuring of multimillion dollar architect and construction/project manager agreements; assessing risk during the design phase; providing guidance on public bidding of contracts and resolving construction-related disputes.
- Played a key role in the negotiation and drafting of health system’s agreement for physician services, including specific performance metrics.
- Counseled health care system in agreement with municipality to merge two existing ambulance services into a new emergency medical services agency.
Compliance Experience
- Built Eskenazi Health compliance program into a robust, system-wide function.
- Created policies, procedures and other compliance program documents.
- Oversaw resolution of compliance hotline calls, managed interal investigations and led multidisciplinary teams focused on particular compliance issues.
