Brian utilizes his dual-jurisdictional admissions, along with his distinctive blend of in-house and patent litigation experience, to obtain robust international patents and develop strategies that protect companies’ products and core technologies in the global marketplace. He advises clients in a variety of industries, including medical devices, food and agriculture, software, telecommunications and aerospace. Brian also counsels clients on how to select and defend trademarks as part of an international branding strategy.
Brian partners with clients to perform U.S. and European patent landscapes and infringement analysis during the client’s product development process. He identifies legal risks associated with incorporating new technologies as products move from development to commercialization. He also develops design-around options and risk mitigation strategies and renders non-infringement and invalidity opinions. Additionally, Brian works with business development departments to identify prospective intellectual property assets for licensing or acquisition.
Brian conducts intellectual property evaluations and product infringement analysis for clients pursuing a merger, an acquisition of new products, and/or licensing of technology. He works to ensure that clients understand the intellectual property value and risks associated with the transfer of assets. He also performs intellectual property due diligence for investors considering investing in technology-based start-ups.
Brian drafts and negotiates patent licenses, technology transfer agreements, research and development agreements and other IP-related agreements.
Before joining Faegre Baker Daniels, Brian was vice president, chief intellectual property counsel for a division of a major multinational medical device company, where he managed all of the intellectual property assets including patent prosecution, product clearance and litigation for numerous medical device product lines.
