Jim Philbin applies his diverse background and business perspective to help clients solve complex corporate challenges including regulatory compliance, labor and employment law, corporate investigations and crisis management. A labor lawyer, litigator and corporate counsel, Jim leverages 25 years of experience as a partner in a global law firm and over a decade of experience as a corporate executive, director and general counsel to provide pragmatic, business-oriented counsel to clients. He has advised clients in industries such as international transportation and logistics, manufacturing, financial services, defense, consumer products, petrochemicals, pharmaceuticals and public construction.

Corporate Compliance and Investigations Counselor

Jim advises on compliance with U.S. and international corporate laws and regulations such as: the FCPA, U.K. Bribery Act and corruption laws; Federal Acquisition Regulations; False Claims Act; OFAC and export controls; and competition laws. He is experienced in conducting high-stakes U.S. and international investigations involving the Departments of Justice, Labor and Treasury, and foreign enforcement agencies and prosecutors. On behalf of clients, Jim has interfaced and successfully resolved matters with the Departments of Justice, Treasury, Commerce, Labor and Homeland Security, Customs, FBI, Federal Maritime Commission, Surface Transportation Board and Environmental Protection Agency.

Labor and Employment Counselor and Litigator

Jim advises and represents employers in dispute resolution and litigation, including class actions and other cases involving:

  • Employment discrimination under Title VII, ADA and ADEA
  • Breach of contract
  • Misappropriation of trade secrets/restrictive covenants
  • FMLA
  • FLSA
  • OSHA
  • Project Labor Agreements
  • The National Labor Relations Act

Jim also advises on labor relations matters, including collective bargaining, representation, election campaigns, arbitration and strikes. He has negotiated project labor agreements (PLAs) on behalf of government entities in numerous states and has successfully defended PLAs when challenged in courts.

Business Experience

For over 10 years, Jim served as the general counsel of Maersk Inc., the North American subsidiary of A. P. Moller-Maersk A/S, a $50 billion international conglomerate with over 100,000 global employees in 120 countries. Jim also served in executive capacities such as executive vice president and chief executive officer and president.

As general counsel, Jim managed the internal legal department and outside counsel in all U.S. Maersk legal matters.
In his executive roles, Jim managed the business affairs of Maersk Inc., including corporate transactions, corporate governance, government relations, HSE, corporate security, human resources, real estate and banking activities, health and welfare plans, and retirement pension and savings plans. Jim also served as chairman of the Maersk Inc. Pension Committee for five years.

Past Experience

Before joining Maersk, Jim practiced labor and employment law with Morgan, Lewis & Bockius in New York City. He also practiced general dentistry for several years before beginning his legal career.

Personal Interests

Jim is very active in youth sports and has been coaching youth and high school lacrosse for 20 years.
